The terms "we", "us" and "our" refer to GLASSVERDE®, the online store operated by GLASSVERDE ECOGLASSWORKS Aneta Fistek, Łukasz Fistek Spółka Cywilna (the "Company"), a civil partnership established under Polish law and based in Poland. GLASSVERDE® operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). GLASSVERDE® is powered by Shopify Inc., which provides the e-commerce platform that enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. Where these Terms distinguish between a "consumer" (a natural person acting outside their trade, business, craft or profession) and a "business customer", the relevant provisions apply accordingly.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services. Nothing in these Terms excludes or limits any rights you may have as a consumer under applicable mandatory law, including Polish consumer law and EU consumer protection rules.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence (18 years in Poland), or that you are the age of majority and you have given us your express consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the full range of Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our store is correct, current and complete and that you have all rights necessary to provide this information. All personal data provided will be processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR).
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person. You must notify us immediately of any unauthorized use of your account.
SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products (including handmade glass products) and services in our online store. However, please note that colors or product appearance may differ from how they appear on your screen due to the type of device you use to access the store and your device settings and configuration. Due to the artisanal nature of some products, slight variations in shape, size, or color may occur and are an inherent characteristic of the manufacturing process; such variations do not constitute a defect or a lack of conformity.
While we strive for excellence, we do not warrant that the appearance of any products purchased by you will be 100% identical to the digital rendering in our online store. This does not affect your statutory rights. For consumers, goods must conform to the contract, and you are entitled to the statutory remedies for any lack of conformity under Polish consumer law (implementing EU Directive 2019/771). For business customers, the statutory warranty for defects (rękojmia) under the Polish Civil Code applies, save as modified in these Terms to the extent permitted by law.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
SECTION 3 - ORDERS AND CONTRACT FORMATION
When you place an order, you are making an offer to purchase. GLASSVERDE® reserves the right to accept or decline your order for any lawful reason. The technical steps required to create the contract between you and us are as follows: you place the order on the website, and we will send you an acknowledgement email. This acknowledgement does not constitute acceptance. Your order is accepted, and a binding contract is formed, only when GLASSVERDE® confirms acceptance or ships the goods.
We must receive and process your payment before your order is accepted. Please review your order carefully before submitting. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made.
Right of Withdrawal. If you are a consumer residing in the European Union, you have the right to withdraw from a distance contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you, or a third party indicated by you (other than the carrier), acquire physical possession of the goods (or of the last item, in the case of multiple items in one order delivered separately). To exercise this right, you must inform us of your decision by a clear statement sent to shop@glassverde.com; you may use the model withdrawal form, but it is not obligatory. Certain contracts are exempt from the right of withdrawal, including the supply of goods made to your specifications or clearly personalized. Full instructions are set out in our Refund Policy.
Your purchases are subject to return or exchange in accordance with our Refund Policy and applicable mandatory laws.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices include applicable VAT but do not include shipping, handling, or potential customs/import charges for deliveries outside the European Union.
Price reductions. Where we announce a reduction in the price of a product, we will also display the lowest price applied to that product during the 30 days preceding the reduction, in accordance with the Omnibus Directive (EU) 2019/2161 as implemented in Polish law.
Prices posted in our online store may differ from prices offered in physical stores or by third parties. We may, from time to time, offer promotions governed by terms separate from these Terms. If there is a conflict between the promotion terms and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information. You represent and warrant that (i) the payment information you provide is true and complete, (ii) you are authorized to use such payment method, and (iii) you will pay all charges incurred at the posted prices, including all applicable taxes and shipping fees.
SECTION 5 - SHIPPING AND DELIVERY
All delivery times provided are estimates only and are not guaranteed, although we make every effort to deliver within the specified timeframe. Details of delivery methods and costs are set out in our Shipping Policy. We are not liable for delays caused by shipping carriers, customs processing, or events outside our reasonable control (Force Majeure). This does not affect your statutory rights as a consumer regarding the time of delivery.
Transfer of Risk. For consumers (B2C), the risk of loss or damage to the products passes to you only when you, or a third party indicated by you (other than the carrier), acquire physical possession of the goods. For business customers (B2B), the title and risk of loss pass to you upon our transfer of the products to the carrier.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, designs, images, graphics, product reviews, and the arrangement thereof, are owned by the Company, its affiliates or licensors and are protected by Polish, EU and international copyright, trademark and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any material from the Services without our prior written consent. Unauthorized use of the Services may be a violation of intellectual property laws. All rights not expressly granted herein are reserved by the Company.
GLASSVERDE® and its associated product names and logos are trademarks of the Company. Shopify's name and logo are trademarks of Shopify Inc. All other trademarks are the property of their respective owners.
SECTION 7 - OPTIONAL TOOLS
You may be provided with access to third-party tools (e.g., payment gateways, analytics) which we neither monitor nor control. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties of any kind. To the extent permitted by law, we shall have no liability arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is at your own risk and discretion. You should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
SECTION 8 - THIRD-PARTY LINKS
The Services may contain hyperlinks to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials. To the extent permitted by law, we are not liable for any harm or damages related to the purchase or use of goods, services, or content made in connection with any third-party websites. Please review the third party's policies carefully before you engage in any transaction.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
GLASSVERDE® is powered by Shopify. However, any sales and purchases you make in our store are made directly with the Company (GLASSVERDE ECOGLASSWORKS Aneta Fistek, Łukasz Fistek Spółka Cywilna). By using the Services, you acknowledge that Shopify is not responsible for the sales transaction, including any injury or damage resulting from products. You hereby release Shopify from claims arising from your transactions with GLASSVERDE®, except where such liability cannot be excluded by law.
SECTION 10 - PRIVACY POLICY AND DATA PROTECTION
All personal information we collect is subject to our Privacy Policy. The data controller is GLASSVERDE ECOGLASSWORKS Aneta Fistek, Łukasz Fistek Spółka Cywilna. As we are based in Poland, we comply with the GDPR (General Data Protection Regulation). Because the Services are hosted by Shopify, certain information is shared with Shopify to process transactions and improve services. Information may be transferred to and stored in countries outside of your residence, including the United States, under appropriate safeguards.
SECTION 11 - FEEDBACK, REVIEWS AND USER CONTENT
If you submit any ideas, suggestions or feedback ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, and display such Feedback for any purpose, including commercial use, to the extent permitted by applicable law. We are under no obligation to maintain Feedback in confidence.
Product reviews. Where we publish consumer reviews of our products, we take reasonable and proportionate steps to verify that the reviews originate from consumers who have actually purchased or used the product, in accordance with the Omnibus Directive (EU) 2019/2161. We do not publish or commission fake reviews and we do not misrepresent reviews to promote products. Information about how we check reviews is available on request at shop@glassverde.com.
You warrant that your Feedback or review: (i) is your original work; (ii) does not violate any third-party rights (copyright, trademark, privacy); and (iii) does not contain unlawful, abusive, or obscene material or viruses. You are solely responsible for the accuracy of any Feedback or review you submit.
SECTION 12 - ERRORS AND OMISSIONS
Occasionally, information on the Services may contain typographical errors or inaccuracies related to descriptions, pricing, promotions, or availability. We reserve the right to correct any errors and to change or update information, or cancel orders if any information is materially inaccurate, including after you have submitted your order. If your order is cancelled due to such an error after payment, we will issue a full refund without undue delay.
SECTION 13 - PROHIBITED USES
You may use the Services for lawful purposes only. Prohibited uses include:
- unlawful purposes;
- violating international or local regulations;
- infringing on intellectual property;
- harassment or discrimination;
- submitting false information;
- uploading viruses;
- spamming or scraping; or
- interfering with security features.
We reserve the right to terminate your use of the Services for violating any of the prohibited uses.
SECTION 14 - TERMINATION
We may terminate this agreement or your access to the Services for conduct that we reasonably believe violates these Terms or is harmful to other users or our legitimate business interests. Termination does not affect any contract of sale already concluded with you. You will remain liable for all amounts due up to and including the date of termination.
SECTION 15 - DISCLAIMER OF WARRANTIES
The information on our Services is for general information purposes. EXCEPT AS EXPRESSLY STATED AND TO THE EXTENT PERMITTED BY APPLICABLE LAW (INCLUDING POLISH CONSUMER LAW), THE SERVICES AND DIGITAL FEATURES OF THE WEBSITE ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE. THIS SECTION DOES NOT EXCLUDE OR LIMIT THE STATUTORY CONFORMITY RIGHTS OF CONSUMERS, NOR THE STATUTORY WARRANTY (RĘKOJMIA) FOR PRODUCT DEFECTS AS PROVIDED BY POLISH LAW.
SECTION 16 - LIMITATION OF LIABILITY
NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, FOR WILLFUL MISCONDUCT OR GROSS NEGLIGENCE, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
SUBJECT TO THE PARAGRAPH ABOVE AND TO THE FULLEST EXTENT PERMITTED BY LAW, GLASSVERDE® AND THE PARTNERS, DIRECTORS OR EMPLOYEES OF THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES. FOR CONSUMERS, OUR LIABILITY IS GOVERNED BY THE APPLICABLE MANDATORY CONSUMER PROTECTION RULES AND IS NOT LIMITED BEYOND WHAT THOSE RULES PERMIT.
SECTION 17 - INDEMNIFICATION
If you are a business customer, you agree to indemnify and hold harmless the Company and Shopify from any claims, damages, or losses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your violation of the rights of a third party. This indemnification obligation does not apply to consumers; the statutory rights and liabilities of consumers remain unaffected and nothing in this Section imposes on a consumer any obligation beyond what is permitted by applicable mandatory law.
SECTION 18 - SEVERABILITY
If any provision of these Terms is determined to be unlawful or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed. This shall not affect the validity of the remaining provisions.
SECTION 19 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right shall not constitute a waiver. These Terms constitute the entire agreement between you and us regarding the Services, superseding any prior versions or communications, without prejudice to any mandatory statutory rights.
SECTION 20 - ASSIGNMENT
You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations under these Terms at our discretion, provided that your rights as a consumer are not diminished.
SECTION 21 - GOVERNING LAW AND DISPUTE RESOLUTION
These Terms of Service shall be governed by and construed in accordance with the laws of Poland. For consumers, this choice of law does not deprive you of the protection afforded by provisions that cannot be derogated from by agreement under the law of your country of residence.
Any disputes shall be submitted to the competent courts in Poland; for consumers, the rules on jurisdiction set out in applicable mandatory law apply.
Out-of-court dispute resolution (ADR). Consumers may use alternative dispute resolution mechanisms. Please note that the European Commission's Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 and is no longer available. In Poland, consumers may seek assistance from the Trade Inspection (Inspekcja Handlowa) and the relevant Provincial Inspectorate of the Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej), from district (municipal) consumer ombudsmen (powiatowy/miejski rzecznik konsumentów), and from consumer organizations. A list of certified ADR entities in the EU Member States is available at: https://consumer-redress.ec.europa.eu/dispute-resolution-bodies. Participation in ADR is voluntary for both parties unless otherwise required by law.
SECTION 22 - HEADINGS
The headings used in this agreement are for convenience only and do not limit these Terms.
SECTION 23 - CHANGES TO TERMS
We reserve the right to update or change these Terms by posting updates to our website. It is your responsibility to check our website periodically. Material changes will be notified to registered users via email or a prominent notice on the site. Changes do not apply retroactively to contracts of sale already concluded. Your continued use of the Services after changes take effect constitutes acceptance.
